AI-driven budget optimization and bid management
Creative generation and A/B testing capabilities
Audience targeting and retargeting features
Performance analytics and reporting
Lead management and processing from Facebook Lead Ads

The Service requires you to connect your Meta and/or Google Ads accounts to enable campaign management functionality.

3. Account Registration and Security

To use our Service, you must create an account and provide accurate, complete information. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access or security breach
Ensuring that your connected Meta and Google Ads accounts comply with their respective platform policies

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Third-Party Platform Integration

Meta (Facebook/Instagram) Integration

By connecting your Meta account to GrowGen, you:

Authorize us to access and manage your ad accounts, campaigns, and related data through Meta's Marketing API
Agree to comply with Meta's Terms of Service and Advertising Policies
Acknowledge that Meta may revoke access at any time according to their policies
Understand that campaign performance is subject to Meta's ad delivery systems and algorithms

Google Ads Integration

By connecting your Google Ads account to GrowGen, you:

Authorize us to access and manage your Google Ads accounts, campaigns, and related data through Google Ads API
Agree to comply with Google Ads Terms of Service and Advertising Policies
Acknowledge that Google may revoke access at any time according to their policies
Understand that our use of Google Ads API is subject to Google API Services User Data Policy

GrowGen is not responsible for any changes, limitations, or disruptions to Meta or Google services that may affect your campaigns.

5. Subscription and Payment

Our Service is offered on a subscription basis. By subscribing, you agree to:

Pay all applicable fees according to your selected plan
Provide valid payment information and authorize recurring charges
Understand that fees are non-refundable except as specified in our refund policy
Accept that prices may change with reasonable notice

Your advertising spend on Meta and Google platforms is separate from GrowGen subscription fees and is billed directly by those platforms.

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period.

6. Acceptable Use Policy

You agree not to use our Service to:

Violate any applicable laws, regulations, or third-party rights
Promote illegal products, services, or activities
Create misleading, deceptive, or fraudulent advertisements
Distribute malware, spam, or harmful content
Attempt to circumvent platform policies of Meta or Google
Interfere with or disrupt the Service or its infrastructure
Access the Service through automated means without authorization
Resell or redistribute the Service without written permission

We reserve the right to suspend or terminate your access for violations of this policy.

7. Intellectual Property

GrowGen and its licensors own all rights, title, and interest in the Service, including all software, algorithms, designs, and content. You retain ownership of your business data, ad creatives, and content you provide.

We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during your subscription period.

Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation to you.

8. Data and Content

You retain ownership of data you provide to the Service. By using our Service, you grant us a license to use, process, and display your data solely to provide and improve our Service.

AI-generated ad creatives and copy created through our Service are provided for your use in advertising campaigns. You are responsible for reviewing and approving all content before it is published.

You are responsible for ensuring your advertising content complies with all applicable laws and platform policies.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:

Specific advertising results, leads, conversions, or ROI
Uninterrupted or error-free service availability
That the Service will meet all your requirements
The accuracy of AI-generated recommendations or content

Advertising performance depends on many factors outside our control, including market conditions, competition, ad platform algorithms, and the quality of your offers and landing pages.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GROWGEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits, revenue, or business opportunities
Loss of data or advertising spend
Service interruptions or platform policy changes
Actions taken by Meta, Google, or other third parties

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to GrowGen in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless GrowGen, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your use of the Service
Your advertising content or campaigns
Your violation of these Terms
Your violation of any third-party rights or platform policies

12. Termination

You may terminate your account at any time by contacting us or using the account settings.

We may suspend or terminate your access to the Service immediately if you breach these Terms, fail to pay fees, or engage in activity that may harm GrowGen or other users.

Upon termination, your right to use the Service ceases immediately. We may retain your data as required by law or for legitimate business purposes.
